HABEAS DATA: En cumplimiento de la ley 1581 del 2.012 sobre “Protección de Datos Personales” reglamentada parcialmente por los Decretos 1377 de 2.013 y 886 de 2.014 y las normas posteriores que la reglamenten, modifiquen o deroguen, el CLIENTE Y/O PROVEEDOR declara y garantiza que ha obtenido la autorización para tratar los datos personales, incluyendo los datos sensibles, de todas las personas naturales, tanto de mayores como de menores de edad incluidas en las bases de datos de ACQUA MARKETING COLOMBIA S.A.S., que incluya directamente el CLIENTE Y/O PROVEEDOR o que ordene a que sean incluidas por ACQUA MARKETING COLOMBIA S.A.S., con el único propósito de cumplir el objeto del vínculo contractual. Por lo tanto, el CLIENTE Y/O PROVEEDOR declara y garantiza que tanto él como ACQUA MARKETING COLOMBIA S.A.S. pueden recolectar, almacenar, utilizar o transferir los datos personales de las personas naturales incluidas en las bases de datos proporcionadas por el CLIENTE, con el único propósito de cumplir el objeto para lo cual ACQUA MARKETING COLOMBIA S.A.S., lo contactó. Como consecuencia de lo anterior, el CLIENTE Y/O PROVEEDOR libera de responsabilidad a ACQUA MARKETING COLOMBIA S.A.S. por cualquier reclamo y/o acción ya se judicial o extrajudicial, de cualquier tercero relacionado con cualquier violación o presunta violación, a los derechos de privacidad o cualquier otro derecho, relacionados con los datos personales que son almacenados en las bases de datos del CLIENTE Y/O PROVEEDOR y/o de ACQUA MARKETING COLOMBIA S.A.S. en los términos del objeto para lo cual, ACQUA MARKETING COLOMBIA S.A.S., lo ha contactado y únicamente para el desarrollo de la relación contractual; en caso de alguna reclamación, demanda o proceso que se inicie en contra de ACQUA MARKETING COLOMBIA S.A.S. por alguno de estos hechos, deberá el CLIENTE Y/O PROVEEDOR adoptar oportunamente las medidas necesarias para mantener indemne a ACQUA MARKETING COLOMBIA S.A.S. y asumir inmediatamente su defensa, de lo contrario deberá pagar todos los gastos en los que ACQUA MARKETING COLOMBIA S.A.S. incurra por estos hechos.
